Clarification Text for the Recruitment Process Regarding the Protection of Personal Data
As the data controller named Arkel Elektrik Elektronik SAN. ve TİC. A.Ş. (Arkel/The Company”), residing at Eyüp Sultan Mah. Şah Cihan Cad. No: 69 B Sancaktepe/İSTANBUL, we truly care about the protection of your personal data. In this context, as the Company, the processing activities for the personal data of employee candidates, intern candidates and apprentice candidates are carried out in compliance with the provisions contained in the Personal Data Protection Law No. 6698 (“The Law /PDPL”).
1. Processed Personal Data
For the employee, intern or apprentice positions at our Company, you can make an application through Kariyer.net or by completing the Job Application Form and delivering it to our Company by hand, by e-mail or through our official website. In this case:
a. In case of making an application to our Company as an employee candidate; Name-surname, gender, date of birth, contact information, address, information about whether you know someone working at Arkel, name-surname information of this person, if available, your education and career information, past work experiences, foreign language knowledge, computer proficiency information, information about the education and certificate that you have received, your mugshot photo if you include it in your CV or application form, information about your military service status, your reference information from your previous workplace, your salary expectations if you indicate it as your preference and other information that you provide in your application are processed. If your CV is deemed eligible and an interview is conducted, the interview notes regarding the assessment of candidates are processed. Also, if physical interviews are conducted at Arkel, your visual and audio recording information may be processed through the security camera used in the workplace.
If you make an application for a disabled position, your special personal data, which is information and documents indicating your disability condition, is processed by our Company.
b. In case of making an application to our Company as an intern candidate or apprentice candidate; Name-surname, gender, date of birth, contact information, address, your school education information and other information that you provide in your application are processed. If your CV is deemed eligible and an interview is conducted, the interview notes regarding the assessment of candidates are processed. Also, if physical interviews are conducted at Arkel, your visual and audio recording information may be processed through the security camera used in the workplace.
Any special personal data, particularly association, foundation and union information and health information that you provide in the CV or job application form that you complete for employee, intern or apprentice positions will not be shared with the Company in any way whatsoever, and if you provide this information in the CV or application form, such data is required to be deleted from the applications to be made to the Company, and then the application will be completed. Your criminal record information is obtained not from all candidates, but from those candidates about whom the Company has a positive opinion for recruitment.
2. Purposes for Processing of Personal Data
The Company may process your personal data obtained in your job application for the following purposes according to the personal data processing conditions prescribed in the Article 5 and 6 of the Law and in line with the purpose of planning and execution of human resources policies and processes (“Purposes”).

- Inviting for assessment and interview, conducting interviews, making assessment for eligible positions, getting to know the employee/intern/apprentice candidate better, managing the recruitment processes, reminding the candidate coming for an interview based on the legal reason for establishing a job/internship/apprenticeship contract,
- Making a job offer to the individuals who have made an application to our Company in case an eligible position arises in the future, keeping the CVs and job application interview and reference notes for this purpose based on the legal reason for the existence of explicit consent,
- If the result of the recruitment process is positive; processing the criminal record data for the purpose of ensuring workplace and other employees safety based on the legal reason for the existence of explicit consent,
- If you make an application for a disabled position, your information regarding your disability condition will be processed for the purpose of determining your disability rate due to the obligation of our Company to employ people with a disability rate of 40% and above based on the legal reason for being mandatory to fulfill legal obligations in the fields of employment, occupational health and safety, social security, social services and social assistance,
- Ensuring workplace safety, recording the purpose and time of office entries and exits, settling disputes and legal cases, making legal claims or filing or defending lawsuits, fulfilling the burden of proof in a possible dispute based on the legal reason for the processing of personal data being mandatory for the establishment, use and protection of a right.
Your personal data may be processed within the scope of internal reporting and statistical studies on the condition that it is anonymized.
3. Purposes of Transfer of Personal Data
In certain cases, the Company may transfer your processed personal data to third parties in accordance with local legislation, particularly the Article 8 of the Law, in order to fulfill the above-mentioned purposes, based on the legal reason for ensuring compliance with the laws for implementation of a contract.
Accordingly, your personal data may be shared with our suppliers, legally-authorized public institutions and private individuals for the foregoing purposes in accordance with the personal data processing conditions and purposes prescribed in the Article 8 of the Law.
If you make an application to our Company as an employee candidate, your personal data may be shared with our third party business partners providing services to us in order to find eligible candidates for our Company based on the legal reason for being mandatory for the conclusion or implementation of a contract.
In addition, personal data may be transferred to third parties such as supervisory authorities, courts, law firms, mediators or legally-authorized public institutions to the extent necessary to comply with applicable legal regulations, to exercise, assert or defend legal rights based on the legal reasons for processing of personal data being mandatory for fulfilling legal obligations and establishing, using or protecting a right.
Also, your personal data may be transferred to new shareholders in case of a possible share transfer or merger, based on the legal reason for concluding a contract and the existence of legitimate interests, provided that it does not damage your fundamental rights and freedoms.
4. Methods and Legal Reason for Collection of Person Data
Your personal data is collected and processed verbally, in writing or electronically, by using fully or partly automatic methods based on the legal reasons described in the sections “Purposes of Processing Personal Data” and “Purposes of Transfer of Personal Data” pursuant to the personal data processing conditions prescribed in the Article 5 and 6 of the Personal Data Protection Law for the sake of assessing your job/internship/apprenticeship application and signing a job/internship/apprenticeship contract as a result of you providing the personal data through Kariyer.net or by completing a Job Application Form and delivering it to our Company by hand, by e-mail or through our official website.
5. Rights of the Data Subject Arising from the Article 11 of the Personal Data Protection Law
As Data Subject, you can forward your requests regarding your rights to us through the e-mail address [email protected]. The Company will fulfill the request as soon as possible and within maximum thirty (30) days depending upon the nature of the request. If this transaction requires an additional cost, we will charge the fee indicated in the tariff determined by the Personal Data Protection Board. The rights of the natural persons, whose personal data is processed according to the Article 11 of the Personal Data Protection Law, are as follows:

- To know whether their personal data is processed;
- To request information if their personal data has been processed;
- To know the purpose of processing their personal data and whether such data has been used appropriately for their purpose,
- To know the third parties to whom their personal data has been transferred domestically or abroad,
- To request rectification in case their personal data has been processed incompletely or inaccurately, and to request provision of information to third parties, to whom personal data has been disclosed, in relation with such rectification,
- To ask for deletion or disposal of personal data after the reasons for processing of such personal data have disappeared, although such personal data has been processed in accordance with the provisions of the Personal Data Protection Law and other relevant laws, and to request provision of information to third parties, to whom personal data has been disclosed, in relation with such deletion or disposal,
- To object to the occurrence of any negative results about data subject through analysis of the processed data exclusively by automatic systems,
- To request indemnification of the loss suffered due to the processing of personal data in violation of the Law.
